New Florida Law Allows DVC to Ban Unruly Timeshare Owners

A new Florida law states that timeshare companies like Disney Vacation Club (DVC) can remove an owner based on their conduct, just like a hotel can remove a regular guest.

DVC Owners Can Be Banned for Poor Conduct

The law is House Bill 429 and goes into effect on Monday, July 1, 2024. It comes over a year after a DVC guest physically assaulted a Cast Member but wasn’t immediately trespassed from Disney property because he was at his home resort, Disney’s Beach Club Resort. It’s possible the guest was trespassed later but Disney had to consult their legal department first.

HB 429 ensures timeshare companies have the same rights as hotel companies. They can call law enforcement to take action against individuals who engage in conduct like assaulting staff. This explicitly includes arrest and/or removal from the property. Action can be taken against a purchaser, owner, or guest. Read the relevant text of the law below.

With regard to any timeshare project as defined in s. 509.242(1)(g), the managing entity or manager has all of the rights and remedies of an operator of any public lodging establishment or public food service establishment as set forth in ss. 509.141, 509.142, 509.143, and 509.162 and is entitled to have a law enforcement officer take any action, including arrest or removal from the timeshare property, against any purchaser, including a deeded owner, or guest or invitee of such purchaser or owner who engages in conduct described in s. 509.141, s. 509.142, s. 509.143, or s. 509.162 or conduct in violation of the timeshare instrument.
