As the situation with the pandemic and COVID-19 vaccine develops, we’ve seen a number of changes made.

Recently, we shared how more individuals in Florida will soon become eligible for the COVID-19 vaccine, and how vaccine passports may be required for travel and more this summer. Florida Governor Ron DeSantis previously indicated that he would ban vaccine passports in Florida, and now he has taken further action to do so.
Earlier today, Governor DeSantis issued an Executive Order regarding vaccine passports. The order specifies that “No Florida government entity, or its subdivisions…shall be permitted to issue vaccine passports, vaccine passes, or other standardized documentation for the purpose of certifying an individual’s COVID-19 vaccination status to a third party.”
Essentially, with this provision, the Florida Governor has banned Florida government entities from issuing any kind of vaccine passport-type documentation.

The Executive Order goes on to state that “Business in Florida are prohibited from requiring patrons or customers to provide any documentation certifying COVID-19 vaccination or post-transmission recovery to gain access to, entry upon, or serve from the business.”
Essentially, the Executive Order prohibits Florida businesses from mandating that customers provide any documentation showing that they have been vaccinated against COVID-19 in order to get service.

The Executive Order further notes that all businesses need to comply with this order “to be eligible for grants or contracts funded through state revenue.”
But, the Order notes that it does not otherwise restrict business from putting other COVID-19 screening protocols in place, in accordance with state and federal law, to protect public health.

The executive order is effective immediately.
