NEW Name and Critical CHANGES Announced for Disney’s Reedy Creek

Over the past several months, we’ve been following the back-and-forth of Disney World and the Florida government, namely the feud with Governor Ron DeSantis.

After Disney spoke out against Florida’s Parental Rights in Education Bill (known commonly as the “Don’t Say Gay” Bill), DeSantis responded by taking steps to dissolve Disney World’s own government — the Reedy Creek Improvement District. The dissolution of the RCID has been a long process since, but now a plan has been announced for what will happen when the process is complete.

House Bill 9B — Reedy Creek Improvement District, Orange and Osceola Counties has been filed by the Florida government. The bill includes several proposed changes for the district.

To start, it says that “The Reedy Creek Improvement District shall continue to be a public corporation of this state and have perpetual existence, but upon the effective date of this act, the Reedy Creek Improvement District shall be renamed the ‘Central Florida Tourism Oversight District.’

There is a transition period of 2 years for Disney to continue using the RCID name and to make the changes outlined in the bill. The bill also notes that “The board of supervisors shall consist of five members appointed by the Governor and confirmed by the Senate, with one member designated as chair of the board of supervisors and one member designated as vice chair.”

Previously, Disney was able to elect their own board members for RCID, but this may change things for the company going forward.

The bill goes on to discuss who is ineligible to serve on the board, including “Any person who, within the past 3 years, has been an officer, owner, director, employee, agent, contractor, or subcontractor of, or has had a contractual relationship with a business entity that owns or operates a theme park or entertainment complex as defined in s. 509.013(9), Florida 2236 Statutes, or a parent company, subsidiary, or sibling organization under common ownership or control with a business entity that owns or operates a theme park or entertainment complex.”

Within the next year (and every five years after that), the board will be responsible for submitting “a report that includes a review of all remaining powers and authorities included herein and any recommendations for consideration of eliminating said powers and authorities for potential repeal by the Legislature.”

Essentially, this is less of a dissolution of the district and more of a renaming and reevaluation of its abilities. The district will still have many of the capabilities it previously had, including the ability to sue, acquire property, lease facilities, exercise the right of eminent domain, manage public utilities, and more.

The bill states explicitly that “Reedy Creek Improvement District is not dissolved as of June 1, 2023, but continues in full force and effect under its new name.”
