A Florida man is suing Disney after a Magic Kingdom ferryboat he was riding crashed into the dock, causing him to fall into a trash can.
Man Suing Disney Following Magic Kingdom Ferryboat Crash
Fox 35 Orlando shared details of the incident, which happened on April 27, 2023. The lawsuit was filed in Orange County this Monday.
Justin Tripp was on a ferryboat traveling from the Transportation and Ticket Center to Magic Kingdom. When boarding, Cast Members told him he would have to stand for the duration of the ride because the boat was “so crowded with passengers.” A trip across Seven Seas Lagoon is about 10 minutes.
Tripp was standing on the back part of the boat when it approached the Magic Kingdom dock and “did not slow down,” the lawsuit alleges. It hit the dock at an “unsafe and high rate of speed causing passengers to be thrown about.”
Tripp states he was thrown into a steel pillar, hitting his neck and head, then fell into a trash can, “which prevented him from possibly being thrown overboard.”
The lawsuit alleges Disney breached its duty to use reasonable care and that Cast Members did not warn passengers of the “imminent collision with the dock.”
Disney knew, or in the exercise of reasonable care should have known, of the actions and inactions that caused the [collision] or crash of the ferry into the dock and failed to correct such conditions.
Tripp said his injuries include those to his neck and head and other parts of his body. The lawsuit lists pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of the ability to earn money, and aggravation of a previously existing condition. He is seeking compensatory damages in excess of $50,000, prejudgement interest, post-judgement interest, and costs.
