Disney, Fox, WB Joint Sports Venture Files Appeal in Fubo Lawsuit

Disney, Fox Corp., and Warner Bros. Discovery’s joint sports streaming venture, Venu Sports, filed an appeal requesting permission to resume its launch plans after Fubo successfully blocked them with an antitrust lawsuit.

Venu Sports logo features "VENU" in bold orange uppercase letters and "SPORTS" in smaller white uppercase letters beneath it, all set against a dark blue background. Perfectly capturing the essence of sports streaming, the design radiates energy and excitement.

The trio announced plans to launch their joint sports streaming service early this year, later revealing the name of Venu Sports and price information. Fubo filed their antitrust lawsuit soon after the initial announcement, alleging the service would create a monopoly and that Disney, Fox, and Warner Bros. “engaged in a years-long campaign to block Fubo’s innovative sports-first streaming business resulting in significant harm to both Fubo and consumers.” The Fubo CEO later said the fight would be a “duel to the death.”

In August, U.S. District Judge Margaret Garnett granted Fubo’s request to block the bundle, writing, “The multi-year monopolistic runway they have created for themselves will provide powerful incentives to thwart competition and hike prices on both consumers and other distributors.”

Deadline shared Venu Sports’ new brief, filed late Friday, September 20, in the U.S. Court of Appeals for the Second Circuit. The brief states:

The district court’s decision contradicts well-settled antitrust law. The ruling denies consumers a new, lower-cost, innovative product—so as to protect Fubo from increased competition. That is the opposite of what the antitrust laws seek to achieve. This Court should reverse.

The brief goes on to state that “Venu is designed to attract price-conscious sports fans who have dropped out of, or never been part of, the traditional TV ecosystem,” that the service would have no exclusive content, and that it would “increase output and lower prices.”

Fubo has until November 4 to file a response.

U.S. Representatives also expressed concerns about Venu Sports this April.

Walt Disney World Cancels Nighttime Spectaculars Due to Hurricane Helene

Walt Disney World has announced that all nighttime spectaculars have been canceled on Thursday, September 26 due to Hurricane Helene.

Nighttime Spectaculars Canceled

A vibrant display of luminous fireworks lights up the night sky over a body of water, with crowds of people watching from the shore. Bright explosions and trails of light create a festive atmosphere.

Walt Disney World has canceled its three scheduled nighttime spectaculars on Thursday, September 26. This means that tonight’s performances of Luminous: The Symphony of Us at EPCOT and Fantasmic! and The Wonderful World of Animation at Disney’s Hollywood Studios will not be performed.

Happily Ever After was not scheduled to be performed at Magic Kingdom since tonight was supposed to be a Mickey’s Not-So-Scary Halloween Party night. The separately-ticketed seasonal event was canceled yesterday.

Walt Disney World is under a tornado watch until at least 8 p.m. EDT on Thursday, September 26. Park operations are expected to return to normal on Friday, September 27, as Hurricane Helene moves out of Central Florida.

Port Canaveral Temporarily Closed, Disney Wish Schedule Adjusted Due to Hurricane Helene

Due to Hurricane Helene, Port Canaveral has temporarily closed and Disney Wish will now arrive in port later than initially scheduled.

Earlier today, Port Canaveral announced via X that the port “is closed and has ceased all waterside and vessel shoreside Port operations until further notice.”

Due to this closure, Disney Cruise Line made the following announcement via their website:

As of September 26, at 10:30 AM we continue to make necessary operational adjustments following Hurricane Helene. Disney Wish is arriving to Port Canaveral on Friday, September 27, 2024, later than originally scheduled. We ask that Disney Wish Guests sailing on Friday, September 27, postpone their arrival to the terminal by five (5) hours after their selected port arrival time, but no later than 7:00 PM. Guests will not be able to access the cruise terminal or parking facility in Port Canaveral until four (4) hours after their selected port arrival time.

There is no estimate on when Port Canaveral will reopen, so there is a chance that Disney Wish itineraries will be adjusted even more on Friday and potentially beyond. We will continue to monitor the situation and provide updates when more information becomes available.

Disney Cruise Line ships, Walt Disney World, and Universal Orlando Resort have seen major operational adjustments due to Hurricane Helene. Disney Fantasy skipped a stop in Grand Cayman, select Walt Disney World tours were canceled and then some were uncanceled, and Mickey’s Not-So-Scary Halloween Party and Halloween Horror Nights 33 were canceled for September 26. Both Universal Orlando Resort and Walt Disney World are under a tornado watch until at least 8 p.m. EDT on Thursday, September 26.
