Drunk Woman Who Fell Into Planter at Walt Disney World Arrested After Declaring “I Want To Go To Jail”

“F*** you. Take me to jail. I want to go to jail,” Marta Kaiser said to an Orange County sheriff’s deputy at Disney Springs.

So he did.

Kaiser, 46, of Lake Worth, was arrested Sept. 28 for disorderly intoxication at the popular outdoor shopping and dining complex at Walt Disney World, according to a newly released Orange County Sheriff’s Office report.

The state attorney’s office declined to prosecute on October 21, ending the criminal case.

Kaiser’s attorney Hal Uhrig argued the police unfairly arrested Kaiser, who was only detained because she angered law enforcement and took up too much of their time, he said.

“The Deputy was wearing his body camera and captured the actual event. Rather than rely on the Deputy’s opinionated conclusions and ‘observations,’ the prosecutors were able to see and hear for themselves. Based on the law and the facts they declined to prosecute,” Uhrig said in a statement.

To violate state law, Kaiser had to be both intoxicated and also endangering the safety of others or property, Uhrig said.

“Ms. Kaiser never endangered anybody or anything,” Uhrig said, adding, “She had an abrasion on her arm, and there is no explanation of how she was injured.”

Authorities said Kaiser was making a scene at Disney Springs leading up to her arrest.

One witness reported Kaiser “appeared intoxicated, had already fallen in a planter, and was verbally disturbing guests,” according to her Orange County Sheriff’s arrest report.

Kaiser was described as having glassy eyes, being aggressive, smelling of alcohol, and slurring her speech in the arrest.

But Uhrig called it loaded language and biases that did not prove Kaiser was, in fact, drunk.

“The odor of alcohol is no evidence of intoxication. Under Florida law you are presumed to be able to drive safely with a blood alcohol level below .05. You will have the odor of an alcoholic beverage on your breath, but the Florida Legislature says you are not intoxicated. ‘Glassy eyes’ are another police favorite, but ‘glassy eyes’ are no evidence of intoxication,” Uhrig said. “Our deputy claims to have heard ‘slurred speech’ but as far as we know, he never heard Ms. Kaiser’s ‘normal (unslurred) voice’ either before or after the arrest.”

Kaiser was also getting into arguments with customers and employees at Disney Springs, the arrest report said.

“I visually observed Ms. Kaiser disturbing two patrons who were attempting to make their way around the business area,” the deputy wrote in the arrest report.

The sheriff’s office intervened and wanted Kaiser to get medical attention for a cut on her right elbow and have her examined near the Coca-Cola Store. They also wanted her to get a ride off Disney Springs, the arrest report said.

“Ms. Kaiser, again, was verbally combative and began to swear profanities at staff and firefighters on site, attempting to render aid. At one point, she began to repeat, ‘F*** you, take me to jail. I want to go to jail,’” the arrest report said. “After numerous attempts to find an alternative, the nature of the disturbance on site, and the large deployment of resources from the business and emergency personnel — Ms. Kaiser was arrested for Disorderly Intoxication.”

She was handcuffed and taken to the Orange County Jail as well as trespassed from Walt Disney World in Orange County.

“She was simply taking up too much of their valuable time,” her attorney said. “The Deputy says they ‘attempted to escort her off the property for her well-being,’ but they never ordered her to leave. We will never know if she would have lawfully departed. That’s because she was arrested for wasting too many important resources, and for cursing at the cops.”
