Woman Suing Disney After Getting Foot Stuck Between Wall and ECV in Little Mermaid Ride Queue at Magic Kingdom

A couple is suing Disney for $50,000 after one of them was injured in the queue for Under the Sea – Journey of The Little Mermaid at Magic Kingdom.

On the afternoon of August 7, 2024, the Montgomery family were in the queue for the Fantasyland ride. Deborah Montgomery, who was a business invitee at Walt Disney World, suffers from chronic arthritis and was using an Electric Conveyance Vehicle (ECV) rented on Disney property.

According to the lawsuit, Deborah’s foot became wedged in a crevice on the wall of the cave-like queue as she reached the end of the line. The lawsuit describes a dramatic slope and a crevice that narrows as the slope increases.

Deborah’s left foot was stuck as the ECV continued forward, causing injury to her foot, ankle, and leg, including a fractured fibula.

The lawsuit also states Deborah experienced severe and permanent shock to her nervous system. She has incurred medical expenses due to the injury, is “unable to continue and pursue a normal life,” and will remain impaired for the foreseeable future.

The lawsuit claims that Disney failed to provide a safe means through the queue, inspect the pathways, provide warning signs, and provide sufficient lighting, particularly for business invitees such as Deborah.

Deborah’s husband, Matthew Montgomery, is also suing Disney for being “deprived of the aide, comfort, society, and companionship of his wife” as well as loss of sleep and loss of income due to taking care of his wife and transporting her to and from medical appointments.
